• <br />AMENDED <br />DEVELOPMENT CONTRACT <br />Stoneybrook <br />THIS AGREEMENT made this 27th day of May, 2003, is by and between the City <br />of Lino Lakes, whose address is 600 Town Center Parkway, Lino Lakes, Minnesota, 55014, a <br />municipal corporation organized under the laws of the State of Minnesota, hereinafter referred to as <br />the "City ", and Tollefson Development, Inc. whose address is 17271 Kenyon Avenue Suite 103 <br />Lakeville Minnesota 55044 hereinafter referred to as the "Developer ". <br />WHEREAS, the Developer has received preliminary plat approval from the City <br />Council for a plat of land within the corporate limits of the City known as Stoneybrook, hereinafter <br />called "Subdivision ", said land is legally described to -wit <br />The East half (1/2) of the Southeast Quarter (1/4), Section 27, Township 31, Range <br />22, except the East 1 -1/2 rods thereof, according to the United States Government <br />Survey thereof and situate in Anoka County, Minnesota; and <br />WHEREAS, the City Council approved a Development Contract on October 14, <br />2002, for Phase I of the development; and <br />WHEREAS, the developer is requesting an amendment to said agreement to provide <br />for Final Plat approval on the entire Development in accordance with the provisions of said <br />document; and <br />WHEREAS, the Developer requested that the City construct and finance certain <br />improvements to service the plat; and <br />WHEREAS, the Developer is to be responsible for the installation and financing of <br />certain private improvements within the plat; and <br />WHEREAS, Minnesota Statute 429 provides a method for assessing the cost of City <br />installed improvements to the benefited property. <br />
