• <br />• <br />• <br />Nature's Refuge <br />DRAFT DECEMBER 14, 2006 EAW Record of Decision <br />page 12 <br />Response: Site - specific data has been collected including infiltration parameters <br />using a double -ring infiltrometer for existing and impacted portions of the property. In <br />addition, surface water and groundwater data has been collected throughout 2006. This <br />data is being used in the development of a hydrologic model of the project site. The <br />proposer has met with the RCWD to discuss the model development and looks forward to <br />continuing collaboration with the RCWD in finalizing the model to represent the existing <br />and constructed environment. The model results will be an important component of the <br />required RCWD permit process. <br />• The Minnesota Pollution Control Agency (MPCA) notes that a Section 401 Water <br />Quality Certification from the MPCA is needed for the issuance of a Section 404 <br />Permit from the U. S. Army Corps of Engineers. The 401 Certification should be <br />included in the list of permits and approvals in Item 8 of the EAW. Although the <br />MPCA will likely waive its 401 authority, an application for the certification is still <br />necessary. <br />Response: The City thanks the MPCA for this clarification and acknowledges the <br />need for the 401 Certification as one of the needed approvals. <br />• The Minnesota Pollution Control Agency (MPCA) comments that to be effective, <br />infiltration areas should not be compacted during construction or receive construction <br />runoff. Soil ripping may be necessary if soil compaction occurs. <br />• The Minnesota Pollution Control Agency (MPCA) comments that it is a state <br />requirement that three feet of separation be provide between the bottom of the <br />infiltration bsins and the seasonally saturated groundwater table. This may be <br />difficult to achieve give the relatively shallow groundwater table. <br />• MPCA recommends that information be provided to homeowners at the time of sale <br />to ensure they understand what a rain garden is, how it works, and why they are <br />important. <br />
