When environmental review is required
and has not yet been completed, the MPCA will issue
a denial without prejudice.
If environmental review is required and has been
completed, the Agency will issue a waiver. This
change in procedure promotes better up -front
environmental planning by emphasizing the
importance of environmental review in the earlier
stages of the project planning process. Furthermore,
because the underlying 401 certification authority is
not changing, the MPCA will always reserve the right
to proceed differently if extreme or unique situations
merit a different approach.
Minn. Rules 7001.1420, regarding the issuance of 401
certification, requires that determinations, including
waivers, must be made only in response to an
application for 401 certification. Therefore, formal
applications for 401 certification must still be sent to
the MPCA (care of Regional Environmental
Management Division, attn: 401 Certification) as they
have been in the past. For projects, this application
would consist of a completed copy of the Minnesota
Local /State /Federal Application Forms for
Water/Wetland Projects or the Minnesota
Local /State /Federal Application Forms for
Water/Wetland Projects - Public Transportation and
Linear Utility Projects (found on the Board of Water
and Soil Resources Web site,
www.bwsr.state.mn.us/programs/maioriprompt.html.
For more information
For more information about current reductions in
MPCA program service, please visit the MPCA's
Web site at www.pca.state.mn.us /about /changes.
