• <br />• <br />• <br />subwatershed basis and promote natural infiltration of runoff throughout the <br />District to: <br />(4- )__ Maximize infiltration on individual sites through Better Site <br />Design practices and advanced stormwater management to <br />control runoff volume increases, <br />(b) Provide effective water quality treatment and- LL-where <br />p - ovide -tr-eatment treatment prier- -tebefore discharge to <br />surface waterbodies and wetlands, while considering the historic <br />use of District water features. <br />(2c) Ensure that future peak rates of runoff are less than or <br />equal to existinffpre- settlement rates. <br />(3) <br />(d) Minimize land use impacts and improve operational and <br />maintenance efficiency by siting stormwater man - gement basins, <br />when needed, regionally unless local resources would be <br />adversely affected. <br />2. REGULATION. A permit andincorporating an approved stormwater management plan is <br />required under this rule for new development, redevelopment, or additions to an existing <br />site, consistent with the following <br />(a) A permit is required for industrial, commercial or multi -unit <br />residential development or redevelopment only for a site at least one acre <br />in size <br />(b) A permit is required for single- family residential development or <br />redevelopment only for a site at least five acres in size. <br />(c) Notwithstanding par -graph (b), a permit is not required for <br />construction of a single- family detached dwelling on an isolated lot. <br />(d) The site size thresholds of paragraphs (a) and (b) and the <br />exception of paragraph (c) do not apply if the site is: <br />(1) Within the 100 -year floodplain; <br />(2) Within 1.000 feet of a public water or protected wetland; or <br />(3) Within 300 feet of Rice Creek, Clearwater Creek, <br />Hardwood Creek or a public ditch. <br />(e) If redevelopment will (i) disturb fifty percent or more of existing impervious <br />surface or (J.) increase impervious surface by fifty percent or more, the <br />requirement of paragraph 3(b)(ii)(b) will apply to all impervious surface on the <br />site. For the purpose of this paragraph, the extent of disturbance is the area of <br />exposure of underlying soils <br />(f) A permit is not required for construction on an individual lot within <br />a residential subdivision if it conforms to a development plan approved by <br />the District <br />(g) A permit is not required for mill and overlay of a public roadway. sidewalk or trait <br />DRAFT DOCUMENT <br />12 <br />
