Routing: <br />Date: July 18, 2007 <br />Below is a summary of proposed changes to the current Rice Creek Watershed District (RCWD) rules. <br />Attached are the documents that provide information on the proposed RCWD rules. They are entitled: <br />1. Rice Creek Watershed District Rules <br />2. Rice Creek Watershed District Statement of Need and Reasonableness (SONAR) <br />The major revisions to the present RCWD rules, adopted August 12, 1998, are as follows: <br />Rule C: Stormwater Management Plans <br />Regulation <br />Current: New development, redevelopment, or additions to an existing site less that 2.5 acres for industrial, <br />commercial, and multi -unit residential, are exempt from the rules unless it is near a floodplain or specified <br />waterbody (Paragraph 2 and Paragraph 6(a)). <br />Proposed: The proposed rule would reduce the scope of the exemption so that it would apply to new <br />development, redevelopment, linear projects, or additions to an existing site at least 1 acre in size for <br />industrial, commercial, and multi -unit residential (Paragraph 2(a)). <br />Current: For site redevelopment at which less than 50% of the total site area (including any road right -or- <br />way) will be disturbed, water quality ponding will be required only for areas being disturbed (Section 6(d)). <br />Proposed: The proposed rule would require that water quality requirements will apply to all impervious <br />surfaces if the site redevelopment either (a) would disturb 50% or more of the impervious surfaces or (b) <br />would increase impervious surface by 50% or more. The extent of disturbance is defined as the area of <br />exposure to underlying soils (Paragraph 2(e)). <br />IllCurrent: There is no language in the current rules addressing mill and overlay projects. <br />An Employee Owned Company Promoting Affirmative Action and Equal Opportunity <br />
