• <br />• <br />RULE C <br />STORM -WATER MANAGEMENT PLANS <br />1. POLICY. It is the policy of the Board of Managers to manage stormwater and snowmelt <br />runoff on a local, regional or subwatershed basis and promote natural infiltration of runoff <br />throughout the District to: <br />(a) Maximize infiltration on individual sites through Better Site Design practices and <br />advanced stormwater management to control runoff volume increases. <br />(b) Provide effective water quality treatment before discharge to surface waterbodies <br />and wetlands, while considering the historic use of District water features. <br />(c) Ensure that future peak rates of runoff are less than or equal to pre - settlement <br />rates. <br />(d) Minimize land use impacts and improve operational and maintenance efficiency by <br />siting stormwater management basins, when needed, regionally unless local resources <br />would be adversely affected. <br />2. REGULATION. A permit incorporating an approved stormwater management plan is <br />required under this rule for new development, redevelopment, or additions to an existing <br />site, consistent with the following: <br />(a) A permit is required for industrial, commercial or multi-unit residential development <br />or redevelopment only for a site at least one acre in size. <br />(b) A permit is required for single - family residential development or redevelopment only <br />for a site at least five acres in size. <br />(c) Notwithstanding paragraph (b), a permit is not required for construction of a single - <br />family detached dwelling on an isolated lot. <br />(d) The site size thresholds of paragraphs (a) and (b) and the exception of paragraph <br />(c) do not apply if the site is: <br />(1) Within the 100 - yearfloodplain; <br />(2) Within 1,000 feet of a public water or protected wetland; or <br />(3) Within 300 feet of Rice Creek, Clearwater Creek, Hardwood Creek or a <br />public ditch. <br />(e) If redevelopment will (i) disturb fifty percent or more of existing impervious surface <br />or (ii) increase impervious surface by fifty percent or more, the requirement of paragraph <br />3(b)(ii)(b) will apply to all impervious surface on the site. For the purpose of this paragraph, <br />the extent of disturbance is the area of exposure of underlying soils. <br />(f) A permit is not required for construction on an individual lot within a residential <br />subdivision if it conforms to a development plan approved by the District. <br />DRAFT DOCUMENT <br />9 <br />
