Carlson, Rezone, Preliminary Plat and <br />Comprehensive Plan Amendment <br />COUNCIL ACTION: Rezone - 415th Vote Required, Comprehensive Plan <br />Amendment - 415th Vote, Preliminary Plat - simple <br />majority <br />BACKGROUND: <br />The Planning and Zoning Board held a Public Hearing on November 12th, 1998 <br />and recommended the following: <br />Approval of the Rezone on a 6- 1(Trehus) vote, <br />Approval of the Comp Plan Amendment on a 6- 1(Trehus) vote, <br />Approval of the Preliminary Plat on a 6 -0 -1 (Robinson) vote with the <br />following conditions: <br />1. Preliminary utility plan subject to the review and approval of the City Engineer. <br />2. The City Engineer shall review and comment on the capabilities of 62nd Street and wehther the <br />funding and resources avalialbe is sufficient to support upgrade of 62nd Street. <br />3. The Grip Plan is reviewed and approved by the City Engineer. The plan may be subject to <br />modification to provide fore maximum number of trees to be preserved. <br />4. The applicant provide a Vegetation Plan and Landscape Plan illustrating the trees to be <br />removed and the trees to be preserved. <br />5. The applicant provide dal vegetation along the trail right-of-way to buffer the recreational <br />and residential uses. <br />6. The Planner & Zoning Board strongly recommends the upgrading or reconstruction of 62nd <br />Street occur as soon as possible. Until reconstruction is completed, West Shadow Lake Road will <br />be blocked at the north end of the development. <br />7. Spruce trees shall be placed in clusters along the trail segment and concrete driveways shall be <br />required. <br />8. A 40' front setback shall be required along West Shadow Lake Drive. <br />g. Neighborhood comments as presented at the public hearing. <br />The City Council reviewed this item at their November 23rd meeting at which <br />time the Applicant, Mr. Carlson, requested a delay to allow him time to meet with <br />some of the adjoining property owners to address their concerns. Since that <br />meeting staff has also received a transportation report from Mr. Carlson's <br />Engineer, Ted Mattke which was submitted to Council in December. Mr. Carlson <br />would now like the Council to reconsider his request and take action. The City <br />
