Box 3448, Tulsa, Oklahoma 74101, 918/588 -3295 ENCROACHMENT AGREEMENT This Encroachment Agreement ( "Agreement ") is made and entered into by and among WILLIAMS PIPE LINE COMPANY, a Delaware corporation, whose address is P.O. Box 3448, Tulsa, Oklahoma 74101 (hereinafter "Williams ") and The City of Lino Lakes, Minnesota, a Municipal corporation, established under the laws of the State of Minnesota, (hereinafter "City ") whose mailing address for the purposes of this agreement is c/o Loucks and Associates, Inc., 7200 Hemlock Lane, Suite 300, Maple Grove, Minnesota 55369 -5592. WITNESSETH: WHEREAS, Williams is the owner of a pipeline known as the Minneapolis- Superior Junction 2- 8" (hereinafter called "Pipeline ") and all or part of the pipeline easements and rights of way (hereinafter called "Easements ") on, over and through portions of the South Half (S /2) of the Southwest Quarter (SW /4) and the Northeast Quarter (NE /4) of the Southwest Quarter (SW /4) of Section 7, Township 31 North, Range 22 West, Anoka County, Minnesota, pursuant to certain instruments recorded in the Register of Deeds Office of said County and described as follows: 1. Right of Way Agreement dated 12/6/57 from Lakeville, Incorporated to Great Lakes Pipe Line Company (Williams' predecessor in interest), its successors and assigns, filed for record on 12/23/57 and recorded in page 550 of book 402 as Document No. 186206. 2. Right of Way Agreement dated 7/15/57 from Harrison J. Maker and Florence House Maker, husband and wife, to Great Lakes Pipe Line Company (Williams' predecessor in interest), its successors and assigns, filed for record on 9/9/57 and recorded in page397 of Book 395 as Document No. 183306.
