AGENDA ITEM NO. 6 K <br />STAFF ORIGINATOR: Mary Kay Wyland <br />MEETING DATE: April 26,1999 <br />ACTION ITEM: Extension of time on Interim Use Permit for Nine (9) <br />Advertising Signs - I -35E <br />COUNCIL ACTION REQUIRED: Simple Majority (3/5 vote) <br />BACKGROUND: <br />The City Council may recall granting approval in April of 1998 to an Interim Use Permit <br />for nine (9) advertising signs located along I -35E. That permit is due to expire and the <br />applicant Eller Media Company (previously Universal Outdoor Inc.) has not been able to <br />secure permits from MnDOT for the location of these signs. They have, therefore, asked <br />the City of Lino Lakes to grant a one -year extension of time for their previously approved <br />Interim Use Permit. <br />Staff would agree with this one -year time extension provided the original conditions of <br />approval are maintained. Those conditions are listed below: <br />1. Applicant identify the homes nearest to the proposed sign sites and demonstrate compliance with the 750 <br />foot setback. <br />2. Applicant demonstrates that sign No 1 meets the 1,200 foot setback requirements from the adjoining GB <br />District. <br />3. A separate interim use permit for each affected property. The permit outlined that the signs shall be <br />removed if the site is rezoned or redeveloped to add another principal use. Sign removal shall be the <br />responsibility of the property owner and the applicant. Both the property owner and the applicant shall sign <br />the approved interim use permit. <br />4. In light of anticipated land use planning along I -35E, we would ask the applicant to reconsider the <br />location and construction of Signs 1 and 2. <br />5. Sign construction plans be subject to review and approval of the City Building Inspector. <br />6. Applicant provide the City with copies of approved off- premise advertising device permits from MnDOT. <br />OPTIONS: <br />1. Approve one -year extension with conditions listed in original Interim Use Permit <br />2. Return to staff for further consideration. <br />RECOMMENDATION: <br />OPTION 1 <br />
