Development Contract <br />Clearwater Creek 3rd Addn. — Phase One <br />VI. BUILDING PERMITS <br />A. Initial Building Permits <br />1. The Developer agrees that seven building permits for model homes may be <br />issued upon approval of the preliminary plat. The right to obtain such <br />building permits shall be contingent upon the execution of this development <br />contract, providing all letters of credit necessary hereunder and posting the <br />appropriate cash escrow required herein. The number of permits allowed <br />above is based upon one for the first ten acres of the subdivision plus one <br />permit for each additional ten acres thereof. These model homes must be <br />located so that they could be on separate ten -acre lots that meet City <br />requirements. Construction shall be limited to maintain a maximum <br />distance of 150' from the furthest exterior wall to an improved street as per <br />the State Fire Code. <br />B. Remaining Building Permits <br />1. The Developer agrees to the following phasing schedule: <br />a. A maximum of 75 building permits will be granted in 1999. <br />b. A maximum of 60 building permits will be granted in 2000. <br />c. A maximum of 45 building permits will be granted in 2001. <br />d. The remainder of the building permits will be granted in 2002. <br />e. Any permits not used one year can be carried over to the next <br />year. <br />2. The Developer agrees that building permits may be issued in accordance <br />with the phasing schedule in VI.B.1. and, other than the model homes, <br />upon approval of the Final Plat by the City Council at which time all <br />required Financial Security shall be in place with the City. The Developer <br />further agrees that City Sewer, Water, Storm Sewer, and Base Construction <br />of the Streets to the minimum extent of the installation of the gravel portion <br />and temporary street signs will be completed prior to the issuance of the <br />remaining building permits. <br />3. 100% of grading in Phase I will be completed, including revegetation <br />of ponding areas, before any building permits are to be issued for <br />Phase II. <br />page 11 <br />
