Second Reading Ordinance 13 -99 June 14, 1999 page 2 Summary of Ordinance 13 -99 701.02 Subd. 9 Reserve two on -sale licenses for restaurants in the Town Center and reserve one license for a restaurant in the I -35E commercial area. The reserved licenses would be only for restaurants seating a minimum of 50 guests at one time and that get at least 50% of gross revenues from non - alcohol sales. 701.03 Clarification that patio, garden, or sidewalk service areas must be described on the license application. Such outdoor areas will require a conditional use permit. 701.04 Removes the list of fees from the liquor ordinance and creates a separate fee schedule that can be amended by resolution. 701.05 Subd. 1 The investigation fee is removed from the ordinance and included in the fee schedule created by a separate resolution. Another change clarifies that investigations of license applicants by the City will be done through the Public Safety Director. 701.05 Subd. 1.a. Adds new paragraph stating that the business must allow police, fire, and health inspections of the premises. 701.05 Subd. 4 Removes the requirement that a corporate license applicant must have a City resident as a manager. 701.06 resident. Removes the requirement that any license applicant must be a City 701.07 Subd. 2 Removes the requirement that a new business must be in operation for six months before it can get a liquor license. 701.07 Subd. 3. Adds a definition of schools for the purpose of the 1000 ft. separation. The separation would apply only to facilities with 25 students or more, that offer a full course of instruction on a daily basis that is provided by an established school board or church. It also excludes post - secondary and vo -tech facilities, and daycare or early childhood facilities where children typically are under constant supervision while at the facility and when traveling to and from the facility. A second addition ensures that a new school within 1000 ft. of an existing license doesn't prevent the license from being renewed. 701.11 Adds a map showing the Town Center and I -35E commercial areas.
