Second Reading Ordinance 13 -99 <br />June 14, 1999 <br />page 2 <br />Summary of Ordinance 13 -99 <br />701.02 Subd. 9 Reserve two on -sale licenses for restaurants in the Town Center <br />and reserve one license for a restaurant in the I -35E commercial area. The reserved <br />licenses would be only for restaurants seating a minimum of 50 guests at one time and <br />that get at least 50% of gross revenues from non - alcohol sales. <br />701.03 Clarification that patio, garden, or sidewalk service areas must be <br />described on the license application. Such outdoor areas will require a conditional use <br />permit. <br />701.04 Removes the list of fees from the liquor ordinance and creates a separate <br />fee schedule that can be amended by resolution. <br />701.05 Subd. 1 The investigation fee is removed from the ordinance and included <br />in the fee schedule created by a separate resolution. Another change clarifies that <br />investigations of license applicants by the City will be done through the Public Safety <br />Director. <br />701.05 Subd. 1.a. Adds new paragraph stating that the business must allow police, <br />fire, and health inspections of the premises. <br />701.05 Subd. 4 Removes the requirement that a corporate license applicant must <br />have a City resident as a manager. <br />701.06 <br />resident. <br />Removes the requirement that any license applicant must be a City <br />701.07 Subd. 2 Removes the requirement that a new business must be in operation <br />for six months before it can get a liquor license. <br />701.07 Subd. 3. Adds a definition of schools for the purpose of the 1000 ft. <br />separation. The separation would apply only to facilities with 25 students or more, that <br />offer a full course of instruction on a daily basis that is provided by an established school <br />board or church. It also excludes post - secondary and vo -tech facilities, and daycare or <br />early childhood facilities where children typically are under constant supervision while at <br />the facility and when traveling to and from the facility. <br />A second addition ensures that a new school within 1000 ft. of an existing license doesn't <br />prevent the license from being renewed. <br />701.11 Adds a map showing the Town Center and I -35E commercial areas. <br />
