AGENDA ITEM 5 B STAFF ORIGINATOR: Mary Kay Wyland DATE: June 28, 1999 TOPIC: PUBLIC HEARING, Ordinance No 16 -99 Vacating roadway and drainage easements in Behm's Century Farms 5th Addition VOTE REQUIRED: 4 /5th The Public Hearing on this item was opened and condinued at the June 14, 1999 City Counicl meeting to the June 28th meeting. Staff would request that this item again be continued to the August 9th City Council Meeting to allow time for review by the Rice Creek Watershed. That review is scheduled for July 28th.. BACKGROUND: Gary Uhde, the developer of Behm's Century Farm's 5th addition, is requesting the vacation of the following described property to facilitate the final platting of his 5th Addition: 1. Laurie Avenue between Palomino Lane and Carl Street. 2. The north 3' of Palomino Lane (old Thomas Avenue) between Sunset Road and Mustang Lane. This vacation will reduce the north half of the right -of -way to 30 feet in width rather than the currently dedicated 33'. Thomas Avenue was originally dedicated as a 66' wide right -of -way. The City currently requires 60' of right -of -way. 3. A 40' wide drainage easement from a point on the existing east/west drainage easement, approximately 130 feet south of old Thomas Avenue to the south line of Outlot B, Sunset Oaks Addition (see crosshatched area on map). This easement will be replaced with an easement between Lots 11 and 12 of Block 3 and Lots 2 and 3 of Block 4, Behm's Century Farms 5th Addition. The City Engineer has reviewed the requested vacations and has indicated that the request is reasonable. Rice Creek Watershed District has been contacted for their comments and will reply prior to the Council meeting. For your information, they have issued permits for construction of the 5th Addition. Staff would recommend adoption of Ordinance No. 16 -99 vacating the roadway and drainage easements as indicated above with the understanding that all required roadway and drainage/utility easements will be dedicated with the Behm's Century Farm 5th Addition Final Plat.
