MEETING DATE: July 26, 1999 TOPIC: - FIRST READING: Ordinance 20 -99 Rezoning from Neighborhood Business to General Business Lots 12, 13, 14, 15, Block 2, Carole's Estates 2 "d Addition - Conditional Use Permit Lot 15, Block 2, Carole's Estates 2 "a Addition - Site and Building Plan Review Lot 15, Block 2, Carole's Estates 2nd Addition American Legion Post 566 VOTE REQUIRED: Rezoning ordinance 4/5, CUP 3/5, Site Plan 3/5 BACKGROUND The City owns four lots consisting of about four acres. The old police station is on one lot. American Legion Post 566 has submitted an application that involves converting the old Lino Lakes police station to a new Legion building. The site currently is City - owned. In order for the project to proceed, the City must sell the lot to the American Legion. Thus, the City is a party in the project. Because of this, staff is making no recommendation and allowing the public process to determine the decision. The continued public hearing on the rezoning and conditional use permit was conducted by the Planning & Zoning Board on July 14. The staff report for that meeting is attached, with the following additional material: lighting diagram received July 13; landscape plan received July 12. At the July 14 P & Z meeting, a resident submitted a petition with the signatures of 83 residents opposing the project. A copy of the petition is attached. A rezoning requires an ordinance, which requires two readings. This is the first reading of the ordinance, which is attached. P & Z ACTION AND CONDITIONS OF APPROVAL The Planning & Zoning Board approved the rezoning, CUP, and site plan, with the conditions listed below attached to the CUP and site plan. The conditions in the July 14 staff report were amended. Condition 9 specifies tree replacement ratio. Condition 21
