AGENDA ITEM 5 A <br />STAFF ORIGINATOR: Mary Kay Wyland <br />DATE: August 9, 1999 <br />TOPIC Oasis Market/Amoco, 7509 Lake Drive, Amended <br />Conditional Use Permit <br />VOTE REQUIRED: Simple Majority <br />BACKGROUND: <br />This item was continued from the 7/21/99 Council Work Session pending completion of <br />site improvements outlined in the staff report. To date we have not received the ponding <br />survey information or the final lighting analysis. Some deflectors have been installed on <br />the southerly light standards, however, there do not appear to be deflectors on the canopy <br />lights. <br />Staff would suggest that the primary issue in this case is whether or not the City should <br />allow a full scale truck stop with overnight parking at this prime location within the Town <br />Center. We have been advised by the Police Department and City Attorney that the City <br />cannot ticket individual truckers for parking in this location. The attorney is looking into <br />whether or not the City can prohibit parking on private property. We do not have such an <br />ordinance at this time The only enforcement action available would be to revoke the <br />CUP if parking continues in violation of the approved conditions. There is no condition <br />prohibiting parking at this time. <br />OPTIONS: <br />The following options for Council action are provided: <br />1. Approve Amended Conditional Use Permit with conditions outlined in the 7- <br />26-99 Staff Report. <br />2. Table consideration to a future meeting provided applicant agree, in writing, to <br />the review extension. <br />3. Deny amendment to existing conditional use permit. This action would allow <br />the use to continue without the two new gas pumps and would not address the <br />parking issues. <br />RECOMMENDATIONS <br />Council discretion <br />
