AGENDA ITEM 5 A STAFF ORIGINATOR: Mary Kay Wyland DATE: August 9, 1999 TOPIC Oasis Market/Amoco, 7509 Lake Drive, Amended Conditional Use Permit VOTE REQUIRED: Simple Majority BACKGROUND: This item was continued from the 7/21/99 Council Work Session pending completion of site improvements outlined in the staff report. To date we have not received the ponding survey information or the final lighting analysis. Some deflectors have been installed on the southerly light standards, however, there do not appear to be deflectors on the canopy lights. Staff would suggest that the primary issue in this case is whether or not the City should allow a full scale truck stop with overnight parking at this prime location within the Town Center. We have been advised by the Police Department and City Attorney that the City cannot ticket individual truckers for parking in this location. The attorney is looking into whether or not the City can prohibit parking on private property. We do not have such an ordinance at this time The only enforcement action available would be to revoke the CUP if parking continues in violation of the approved conditions. There is no condition prohibiting parking at this time. OPTIONS: The following options for Council action are provided: 1. Approve Amended Conditional Use Permit with conditions outlined in the 7- 26-99 Staff Report. 2. Table consideration to a future meeting provided applicant agree, in writing, to the review extension. 3. Deny amendment to existing conditional use permit. This action would allow the use to continue without the two new gas pumps and would not address the parking issues. RECOMMENDATIONS Council discretion
