AGENDA ITEM 5 A <br />STAFF ORIGINATOR: Mary Kay Wyland <br />DATE: August 23, 1999 <br />TOPIC: Oasis MarketlAmoco, 7509 Lake Drive, Amended <br />Conditional Use Permit <br />VOTE REQUIRED: Simple Majority <br />BACKGROUND: <br />This item was continued from the 7/21/99 Council Work Session pending completion of site <br />improvements outlined in the staff report. To date we have not received the ponding survey <br />information or the final lighting analysis, however, Mr. Dan Price, the Oasis Market <br />representative, has been on vacation. Deflectors have been installed on the southerly light <br />standards and the southerly side of the canopy lights. We have not, as of yet, received a copy of <br />the light schematic. Additionally, we have asked the applicant to supply a revised landscape plan <br />that will provide additionally fencing and plantings along the southern border. <br />Staff would suggest that the primary issue in this case is whether or not the City should allow a <br />full scale truck stop with overnight parking at this prime location within the Town Center. The <br />site was originally designed, an approved, with the truck parking, restrooms with showers, and <br />booths with telephones to provide convenience for the truckers. We have been advised by the <br />Police Department and City Attorney that the City cannot ticket individual truckers for parking in <br />this location. The attorney has indicated that the City would need to adopt an ordinance <br />prohibiting parking on private property in order to enforce a "no parking" provision for this CUP. <br />We do not have such an ordinance at this time. <br />In lieu of attaching an unenforceable condition to this CUP, the Council could consider an <br />enhanced fencing and landscaping plan that would provide addition screening on the south side <br />of the site. The south side appears to be the only feasible location for the truck/trailer parking. <br />OPTIONS: <br />1. Table consideration to a future meeting provided applicant agree, in writing, to the review <br />extension. Prior to the future meeting staff should receive survey of the pond, lighting <br />schematic, and revised landscaping plan. <br />2. Deny amendment to existing conditional use permit. This action would allow the use to <br />continue without the two new gas pumps and would not address the parking issues. <br />RECOMMENDATION: <br />Option 1 <br />
