MEETING DATE: TOPIC: AGENDA ITEM 5 B Jeff Smyser September 13, 1999 New Open Space Management Plan Clearwater Creek 3`d Addition CITY COUNCIL ACTION: 3/5 vote BACKGROUND The developer of Clearwater Creek 3'd Addition, Gar -Em Development, has put together a new open space manage ent plan. Because the new management plan is more extensive and complete, siaf is recommending that the City Council approve the new plan as a replacement for the one previously approved by the Council. The City Council approved an open space management plan for the project on June 14. Approval of the`management plan was required as a condition of approval for the plat. The developer is requesting that the new management plan replace the minimal plan that was approved in June. The new plan includes a map of specified areas oldie project. The text of the document lists specific management activities and describes which activities are to occur in the mapped areas. As the restoration work continues, the developer's consultant may prepare additional, more detailed work plans for some of the areas. The listed management actil cities will be conducted by the developer at the developer's expense. The costs are incluuded in the financial guarantees as part of the development agreement, just as road and ;utility work is backed by financial guarantees. The development agreement will include the open space plan as an attachment. The development agreement is ready except for this final piece. The development agreement must be completed before final plat approval. Final plat approval is on the agenda tonight. OPTIONS 1.
