AGENDA ITEM 5E STAFF ORIGINATOR: Mary Kay Wyland DATE: September 27, 1999 TOPICS Sue Walseth, 6408 Cassiopeia Court, Variance VOTE REQUIRED: Simple Majority BACKGROUND; Sue Walsetti is constructing a new home on the north/east corner of Holly Drive and Cassiopeia Court. She has an above ground pool and a large, out -door dog, and would like to install a 6' privacy fence in her rear & side yard. The property is Zoned R -1X and according to the Zoning Ordinance Section 3. General Provisions, Subd. 4 T. Fences and Walls. Fences and walls shall require a building permit and shall be permitted in all yards subject to the following: 1. Height. b. Should the rear lot line of a lot be common with the side lot line of an abutting lot, that portion of the rear lot line equal to the required front yard of the abutting lot shall not be fenced to a height of more than four (4) feet. The Zoning Ordinance additionally provides 4. Residential istrict, ,R. end. Fences in residential districts may be located in any yard to a height of four (4) feet, except that a fence up to six (6) feet may be erected from the front facade of the principal building to the side and/or rear lot line As mentioned above, Ms. Walseth has a corner lot and would like to construct a 6' privacy fence on her rear lot line and her side lot line (Holly Drive) to approximately the front of her hone. This section of the Ordinance would prohibit the construction of a 6' fence from the setback line of the adjoining home on Holly Drive (40') and also along Holly Drive to the front of her home (see attached sketch). The Ordinance would allow a 4' fence. In addition, Anoka County has established sight/distance guidelines which, if used in considering this request, would support the intent of the Ordinance requirement limiting the fence height to 4' (see attached sketch indicating sight/distance triangle).
