AGENDA ITEM 5E <br />STAFF ORIGINATOR: Mary Kay Wyland <br />DATE: September 27, 1999 <br />TOPICS Sue Walseth, 6408 Cassiopeia Court, Variance <br />VOTE REQUIRED: Simple Majority <br />BACKGROUND; <br />Sue Walsetti is constructing a new home on the north/east corner of Holly Drive and <br />Cassiopeia Court. She has an above ground pool and a large, out -door dog, and would <br />like to install a 6' privacy fence in her rear & side yard. The property is Zoned R -1X and <br />according to the Zoning Ordinance Section 3. General Provisions, Subd. 4 T. <br />Fences and Walls. Fences and walls shall require a building permit and shall be <br />permitted in all yards subject to the following: <br />1. Height. b. Should the rear lot line of a lot be common with the side lot line of <br />an abutting lot, that portion of the rear lot line equal to the required front yard of the <br />abutting lot shall not be fenced to a height of more than four (4) feet. <br />The Zoning Ordinance additionally provides <br />4. Residential istrict, ,R. end. Fences in residential districts may be located in any yard <br />to a height of four (4) feet, except that a fence up to six (6) feet may be erected from the <br />front facade of the principal building to the side and/or rear lot line <br />As mentioned above, Ms. Walseth has a corner lot and would like to construct a 6' <br />privacy fence on her rear lot line and her side lot line (Holly Drive) to approximately the <br />front of her hone. This section of the Ordinance would prohibit the construction of a 6' <br />fence from the setback line of the adjoining home on Holly Drive (40') and also along <br />Holly Drive to the front of her home (see attached sketch). The Ordinance would allow a <br />4' fence. <br />In addition, Anoka County has established sight/distance guidelines which, if used in <br />considering this request, would support the intent of the Ordinance requirement limiting <br />the fence height to 4' (see attached sketch indicating sight/distance triangle). <br />In considering all requests for variance or appeal and in taking subsequent action, the <br />City shall make a finding of fact: <br />
