AGENDA ITEM 5 A <br />MEMORANDUM r <br />October 6 , 1999 <br />to: Mayor and City Council <br />from: Jeff Smyser <br />subject: Final Plat, Lino Lakes Commercial, Development <br />JADT Development Group <br />Northeast Quadrant, Lake Drive and I -35W <br />We have placed the JADT final plat on the agenda for the October 11 meeting. As of <br />today, we have not received the information necessary for approval of the final plat. A <br />developer's agreement is a key part of this. Staff has notified the applicant that if the <br />necessary information is not received by noon, Friday, we will pull the item off the City <br />Council agenda. It is the applicant's responsibility to submit the required information. <br />If we receive the information necessary for approval, we will prepare a full greensheet <br />report and forward it to you <br />A final plat drawing has been submitted. The final plat conforms to the approved <br />preliminary plat. However, drainage easements must be added. The City Attorney has <br />reviewed the title commitment. Two signatures must be added to the signature page or <br />those signatories' interests released. The applicant is responsible for making these <br />changes and submitting an amended plat drawing and signature page. <br />We do not have a complete developer's agreement, which is necessary before the final <br />plat can be approved. The City has submitted to the applicant a modified version of our <br />standard developer's agreement. The City Attorney has reviewed it, and the City's <br />interests are protected. The applicant has not yet responded. <br />Another requirement for final plat approval is completion of applicable conditions of <br />approval. Conditions that apply to the plat include obtaining necessary approvals from <br />Anoka County and the Minnesota Dept. of Transportation- (MnDOT). MnDOT has stated <br />that it does not require a permit until development immediately adjacent to their right of <br />way is proposed, which will occur in the fixture. We have not received notice of the <br />status of Anoka County's permit. It is the applicant's responsibility to obtain County <br />approval and submit a copy to the City. <br />
