MEETING DATE: October 11, 1999 <br />TOPIC: <br />-Site and Building Plan Review <br />- Variances from Setback from Ordinary High Water Level <br />- Variance for the Number of Parking' Stalls <br />Shirley Kaye's, 6810 Lake Drive <br />VOTE REQUIRED: 3/5 <br />BACKGROUND <br />The application for a site plan review is for an addition to the existing building for <br />Shirley Kaye's, a bar and restaurant at Lake Drive and Hodgson Rd. (CSAH 23 and <br />CSAH 49). The plan includes additional dining/bar area, space for a new liquor store, <br />and paved parking. <br />The variances are requested because both the proposed new building addition and the <br />parking lot would not meet the shoreland setback from Ordinary High Water Level of <br />Rice Lake: 150 feet required on a natural environment lake. Another variance is <br />requested for the number of parking stalls. <br />The GB General Business district lists restaurants as well as on and off sale liquor as <br />permitted uses. <br />The Planning & Zoning Board approved the site plan and variances on April 14, with <br />conditions. The applicant has requested several extensions to redesign the building and <br />site plans to meet the concerns expressed by the P & Z Board and staff Since then, staff <br />has reviewed several revised plans to advise the applicant on how to resolve the concerns. <br />Because of the state deadline law, the City must act on the application October 11 or <br />receive another agreement from the applicant to extend the review period. <br />ANALYSIS <br />Wetlands: To our knowledge, the Rice Creek Watershed District (RCWD) has not <br />approved the wetland delineation. Approval of the drainage plan by the RCWD and the <br />City Engineer are standard conditions of approval. <br />
