MEETING DATE: <br />TOPIC: <br />Jeff Smyser <br />October 25, 1999 <br />CITY COUNCIL ACTION: <br />-Final Plat, Lino Lakes Commercial Development <br />JADT Development Group <br />Northeast Quadrant, Lake Drive and I -35W <br />3/5 vote <br />BACKGROUND <br />The City Council approved the final plat with conditions on October 11. One of the <br />conditions was that the approval was effective for two weeks. If all the conditions were <br />not met in that time, the Council would reconsider the plat approval. <br />Steps necessary for a final plat include a final plat drawing that conforms with the <br />preliminary plat, City Attorney review of the title commitment, a complete developer's <br />agreement, and completion of applicable conditions of approval. <br />A revised fmal plat drawing with all necessary elements will be submitted by the <br />developer. The City Attorney is reviewing the revised title information. Staff will ensure <br />all conditions are met. The main issue is the developer's agreement. <br />The developer and City are discussing elements of the development agreement, <br />particularly the financing and ownership of the road. If this issue is resolved before the <br />City Council meeting, the project can proceed. <br />If all the issues are not resolved, the City can again grant conditional approval of the fmal <br />plat, extending the time of approval. Alternatively, the City can deny the final plat and <br />the developer would simply submit the necessary information in the future. There is no <br />waiting period for resubmittal of a final plat. <br />Last time, the Council added a two -week limit on the conditional approval. The same <br />could be included as a condition tonight. It is included as condition 19. If the Council <br />does not want this to apply, condition 19 should be deleted. <br />
