As you know, the City acquired some <br />property from Mr. Vaughan that was subsequently exchanged with Anoka County. <br />The matter came up for trial last spring and it became clear that there was a <br />Sdiscrepancy between what property the City intended to acquire and what property <br />the City in fact did acquire. As part of the settlement we agreed to petition Anoka <br />County to reconvey to us certain small parcels of property in order to adjust the <br />property lines and avoid interfering with Mr. Vaughan's preliminary plat. <br />We went though a very long process of getting surveys and presenting the <br />information to Anoka County. Fortunately, Anoka County has agreed to reconvey <br />some parcels of property to the City which we can in turn reconvey to Mr. Vaughan. <br />The matter was heard and approved by the Anoka County Park Board and also <br />approved unanimously by.the Anoka County Board. <br />am requesting that this item be placed on the agenda at the next City Council <br />meeting scheduled for September 27. We are requesting that the City Council <br />authorize the conveyance of the property received from Anoka County directly to Mr. <br />Vaughan. The terms of the settlement agreement approved by the Judge require this <br />reconveyance. My suggestion is that you prepare a short presentation for the Council <br />summarizing the initial land transfer, the problems that developed at trial and the <br />solution that we reached with Mr. Vaughan and Anoka County. I am enclosing a map <br />describing the property that we are receiving from Anoka County and conveying to <br />Mr. Vaughan should you need to use this with the City Council. <br />spoke with Dan Klint and he indicated that he had sent the deed to the County Board <br />for signature and I expect that we will receive that prior to the City Council meeting. <br />We will prepare a deed for signature at the time of the City Council meeting. We will <br />then forward that to Mr. Vaughan and, hopefully, conclude successfully, I think, this <br />fi0 litigation. <br />
