AGENDA ITEM 6C <br />STAFF ORIGINATOR: Mary Kay Wyland <br />DATE: October 25, 1999 <br />TOPIC: Johnson/Killey, 261 & 271 Elm Street, Minor Subdivision <br />VOTE REQUIRED: Simple Majority <br />BACKGROUND: <br />Mr. and Mrs. Johnson currently own the property at 261 Elm Street which consists of a <br />108' x 208' parcel containing their home and a 56' x 216' parcel to the north of their <br />home. They would like to transfer the east 56' x 108' of this parcel to the Killey's. The <br />proposed conveyance would provide for two parcel, each consisting of a 108' x 264' <br />parcel. <br />The property in question is Zoned R -1 Single family and indicated as such on our Land <br />Use Plana City sewer and water are not currently available to these parcels, however, it <br />may be extended in the future when Elm Street is upgraded. <br />Staff has reviewed this request and would recommend approval. There are no existing <br />easements needing vacation and the realignment will provide two parcels consistent in <br />depth with the eight parcels to the east. We would comment that there appears to be a <br />.50' discrepancy on the half section map which may be a title concern for the two <br />property owners. The Centennial School District owns the property to the north and this <br />discrepancy may involve the District. We believe this issue is a private matter between <br />the District and the property owners and are merely pointing it out at this time. <br />In summary, staff would recommend approval of this minor subdivision with the <br />following condition: <br />1. The proposed subdivision shall be recorded with Anoka County. <br />2. The newly described parcels shall be combined for taxes purposes with new <br />Property Identification Numbers (PIN) issued that combine Parcel 0011 with the <br />west 108 feet of Parcel 0023 and Parcel 0012 with the east 108 feet of Parcel <br />0023. <br />The Planning and Zoning Board recommended approval on a 7/0 vote at their October 13, <br />1999 meeting. <br />OPTIONS: <br />1. Approve with conditions indicated above. <br />2. Return to staff for further consideration <br />RECOMMENDATION: <br />Option 1 <br />
