AGENDA ITEM 6D <br />STAFF ORIGINATOR: John Powell, City Engineer <br />COUNCIL MEETING DATE: November 8, 1999 <br />TOPIC: Consideration Resolution No 99 -102, Adopt Assessment Roll, <br />I35WRH49 Interchange Commercial Development Trunk <br />VOTE REQUIRED: Simple Majority <br />BACKGROUND; <br />On September 13, 1999, the City Council set the Public Hearing for the <br />proposed assessments for the 135W/TH49 Interchange Commercial <br />Development Trunk project for Monday, October 25, 1999. The Public Hearing <br />was not held to allow time for discussion of the City's assessment policy for <br />properties which will be developed or re- developed in the near future. The City <br />has also received objections to the proposed assessments. <br />Deferment of the assessments until the properties are developed is supported <br />for the following reasons: <br />1. Assessment deferment in developing areas has been previously allowed in <br />the City of Lino Lakes. <br />2. The properties proposed to be assessed will likely develop in the near future. <br />3. This project has been funded by the City's Area and Unit Trunk account. <br />4. The basis for utility assessments is the developable area and the intensity of <br />the water and sewer use These can be more accurately calculated after a <br />specific site use is known. <br />We recommend the assessments for this project be deferred until such time as <br />the properties develop and connect to City utilities. Resolution No 99 -102 has <br />been modified to reflect this intent. <br />OPTIONS: <br />1. Return to staff for further review. <br />2. Adopt the original assessment roll for the l35W/TH49 Interchange <br />Commercial Development Trunk project. <br />3. Adopt Resolution No 99 -102 deferring the sanitary sewer and water <br />assessments until such time as the properties develop. <br />RECOMMENDATION: <br />Staff recommends Option No. 3, Adoption of (revised) Resolution No. 99 -102. <br />
