REVISED GREEN SHEET - PLEASE REPLACE ORIGINAL <br />AGENDA ITEM 6 A <br />STAFF ORIGINATOR: Mary Kay Wyland <br />DATE: November 22, 1999 <br />TOPIC: <br />PUBLIC HEARING, First Reading of Ordinance No. <br />23 - 99 Vacating Document #1128982 and #1148602, <br />Trail Easements for Fox Trace <br />And <br />Accepting New Trail Easement Document <br />VOTE REQUIRED: 4/5TH <br />City Staff has received a request from R- Property, Inc. to vacate two trail easement <br />documents recorded for the development known as Fox Trace. These easements were <br />recorded in July and December of 1994 prior to the exact trail location. Since that time, <br />the trail has been constructed, accurately defined and a permanent easement recorded on <br />October 19, 1999. The City will also need to accept this new permanent easement. <br />This new document correctly defines the constructed trail document and serves to replace <br />the two easement documents being vacation. The document does contain a typographical <br />error on the second page indicating that it is replacing Document No 1138062 rather than <br />#1148602, however, our City Attorney has reviewed the material and indicated this error <br />is of no consequence to the City. The document defines the trail easements accurately <br />and the City will be vacating the previous easements. <br />Staff would recommend adoption of Ordinance No. 23 - 99 Vacating Document <br />#1128982 and #1148602 (Fox Trace Trail Easements) as they are not necessary and have <br />been replaced with a new document. Staff would also recommend acceptance of the new <br />Permanent Easement Document. This new document was recorded with Anoka County <br />on October 19, 1999. <br />OPTIONS: <br />1. Approve First Reading of Ordinance No 23 - 99 <br />2. Accept Trail Easement Document dated September 1, 1999 <br />3. Return to staff for further consideration <br />RECOMMENDATION: <br />Option 1 and Option 2 <br />
