In summary, it appears that the District's compensatory storage requirement <br />has been fulfilled, although not in the manner specified in the original grading plan and permit. <br />At this point, we do not see a need to regrade the entire easement area to bring it into conformance with the original grading <br />plan. However, we do recommend that the swale from the Schwartz property line to the pond be regraded as discussed in the <br />enclosed report. <br />With regard to the proposed easement vacation, as a minimum, easement should be retained over the existing pond, the <br />drainage swale and any area below Otter Lake's HWL of 912.9. We feel that any decisions relative to vacation of other <br />portions of the easement are best left to the City as we understand that there are a number of ancillary issues unrelated to the <br />District's permit requirements. <br />Lastly, we would point out that our findings relative to compensatory storage are based on the survey information furnished by <br />the developer. Since the survey was prepared by a reputable Registered Land Surveyor, we have no reason to question its <br />accuracy. However the Schwartzes have pointed out discrepancies between the E.G.Rud survey and a survey done by <br />Advance Surveying and Engineering, and have requested further verification of the elevation data upon which the <br />compensatory storage calculations are based (refer to letter dated 11/2/99 from the Schwartzes which you were previously <br />copied on).
