STAFF ORIGII <br />DATE : <br />TOPIC: <br />R: Rick DeG, rdner <br />January 16, 1998 <br />Accept Easement - Clearwater Creek 2n <br />Addition <br />B VMKGRO ND : <br />The Final Plat for the Clearwater Creek 211c1 Addition was approved <br />by the Council in September of 1996. At that time a 15' wide <br />trail, indicated as "Park" on the plat was dedicated on the rear . <br />lot lines of those lots west of Tele Lane. <br />Following completion of site grading staff found that <br />installation of the trail as shown on the Final Plat would <br />r require the removal of, a number of deciduous trees, including <br />some significant Oak Trees. Consequently, staff worked with the <br />developer to provide a total easement as indicated on Exhibit B. <br />At the September 22, 1997 Council meeting Council referred this <br />trail easement back to the Park Board for further consideration. <br />The Park Board reviewed three options at their January 5, 1998 <br />meeting. Those options included the following <br />Option 1 - Accept the existing trail location and easement <br />alignment and screen the trail where appropriate. This option <br />impedes on the minimal lot size required by ordinance (10,800 <br />sq. feet). Also, the existing house on Lot 5 is 29' from the <br />existing trail. The advantage is that the large deciduous trees <br />located along the property line would remain intact. <br />Option 2 - Remove large deciduous trees and relocate the trail <br />where it was originally platted. This option would not impede <br />on the minimal lot size requirement, but would eliminate some <br />very large oak trees located along the property line. <br />Option 3 - Abandon existing trail and place on Otter Lake Road <br />right -of -way. This would result in a buffer 4' between the <br />existing bituminous surface and the trail. County standards <br />call for a minimum set -back off the roadway of 20', with a <br />preferred set-back of 30'. The Park Board considered this <br />option but with the limited buffer and the speed limit at 50mph, <br />this option was not viable. <br />
