AGENDA ITEM 6B <br />STAFF ORIGINATOR: David Ahrens, Public Works Director /City Engineer <br />DATE: January 26, 1998 <br />TOPIC: Resolution No. 98 -08, Consider Joint Powers Agreement with City <br />of Centerville, 21st Avenue Street and Utility Project <br />INTRODUCTION: <br />Staff is requesting Council approval of a Joint Powers Agreement between the <br />City of Lino Lakes and the City of Centerville for construction cost and <br />maintenance responsibilities of 21st Avenue. <br />BACKGROUND: <br />The need for a Joint Powers Agreement is a result of Council approval of the <br />Clearwater Creek Business Center plat at the December 15, 1997, Council <br />Meeting. The plat is located south of Main Street between 35E and 21' Avenue <br />(refer to enclosed location map ). The road serving the plat is 21st Avenue which <br />is centered on the corporate boundary of Lino Lakes and Centerville. The City of <br />Lino Lakes has prepared a feasibility study for improving 21' Avenue (discussed <br />under separate agenda item) and one of the main issues is the cost sharing and <br />maintenance responsibilities between Lino Lakes and Centerville. <br />DISCUSSION: <br />The proposed Joint Powers Agreement has been reviewed by the City Attorney, <br />engineering consultant and staff. The Agreement is under review by Centerville <br />officials with discussion taking place at the January 21, 1998, worksession with <br />possible action taken on January 28, 1998, Council Meeting. To date staff has <br />not heard of any outstanding issues from Centerville. <br />The Agreement states that all project costs, except property acquisition, related <br />to street and storm sewer work will be split equally between the two cities. The <br />utility work is within Lino Lakes and therefore, is Lino Lakes responsibility. <br />Maintenance responsibilities include Centerville providing winter snow removal <br />and sanding and Lino Lakes providing street sweeping, pothole filling and crack <br />sealing. Future sealcoating will be completed under separate agreement. Each <br />City has approval over the other City's driveway locations. <br />OPTIONS: <br />1. Return to staff for further review. <br />2. Adopt Resolution Number 98 -08 authorizing and directing the Mayor and City <br />Clerk to sign the Joint Powers Agreement with Centerville for 21st Avenue <br />
