M E M O R A N D U M <br />DATE: February 3, 1998 <br />TO: Mayor and City Council <br />FROM: Mary Kay Wyland <br />RE: R -BR Zoning District/Advertising Signs <br />CC: Brian Wessel <br />Staff has been asked by Mr. Mike Cronin, representing Universal Outdoor Inc., to <br />seek support from the City Council for the attached resolution. This resolution <br />basically outlines the provisions of the existing City Sign Ordinance which allows <br />advertising signs in the R -BR Zoning District by Conditional Use. It also <br />reiterates the purpose of the R -BR Zoning District as a "future" commercial <br />district. <br />The purpose for this resolution is to highlight the provisions of the sign ordinance <br />and conditional uses in the R -BR Zoning District for use by Universal Outdoor <br />Inc., and any other sign company, in their petition to MnDOT for issuance of a <br />permit for an Advertising sign along 35 E in this R -BR Zoning District. Current <br />procedure requires issuance of a MnDOT permit prior to review of a Conditional <br />Use Permit to allow an advertising sign in the R -BR Zoning District. MnDOT has <br />stated that in their opinion, the R -BR Zoning District is an agricultural district and <br />therefore, not appropriate for advertising signs according to the Federal <br />"Highway Beautification" Regulations. Those regulations state that advertising <br />signs are allowed in commercial and industrial zoning districts only. Our City <br />Ordinance, however, prohibits advertising signs in all but the R -BR Zoning <br />District. Additionally, the City's EDAAB, Planning & Zoning Board, and City <br />Council, have all previously determined, via adoption of the existing Sign <br />Ordinance, that advertising signs are allowed in the R -BR Zoning Distrist by <br />conditional use. <br />Requested Action: <br />1. Place this item on a future (Feb. 23) Council Agenda for action supporting the <br />attached resolution. <br />2. Take no action as City Ordinance currently supports advertising signs in the <br />R -BR Zoning District. <br />3. Other option as suggested by Council <br />
