B. That the plight of the landowners is due to circumstances unique to his property not created by <br />the land owner. The site is unique as it is an existing apple orchard. <br />C. That the hardship is not due to economic considerations alone and a reasonable use for the <br />property exists under the terms of the ordinance: The applicant maintains that in order to be <br />competitive, this additional storage/sales space is necessary. <br />D. That granting the variance requested will not confer on the applicant any special privilege that <br />would be denied by this ordinance to other lands, structures, or buildings in the same district. <br />Under similar circumstances we could consider a similar request. <br />E. That the proposed actions will not unreasonably diminish or impair established property values <br />within the neighborhood. The proposed actions do not seem to diminish established <br />property values in the area. <br />F. That the proposed actions will be in keeping with the spirit and intent of the ordinance. <br />Granting the variance would be in keeping with the intend of the R -BR Zoning District as <br />this is a agricultural business. <br />The Planning and Zoning Board reviewed this item at their May 13th meeting <br />and recommended approval of a variance for the number of accessory buildings <br />and for an additional 215 square feet of accessory building area. There was <br />discussion concerning various options such as requiring the additional square <br />feet to be added to one of the existing buildings thereby reducing the variance <br />for number of buildings, or, in the alternative, to reduce the size of the proposed <br />structured by 215 sq. ft. thereby requiring a variance for number of buildings <br />only. Upon review of these options with the applicant the P & Z approved both <br />variances requested. <br />OPTIONS: <br />1. AIIow construction of an additional accessory building at 768 sq. ft. thereby <br />requiring a variance for the number of accessory buildings an additional 215 sq. <br />ft. of accessory building. <br />2. AIIow an alternate to the variance requested. <br />3. Deny variance request. <br />RECOMMENDATION: <br />Option 1 <br />
