COUNCIL MINUTES July 8, 1996 <br />- All dogs must be kept under restraint by their owners at all times <br />- Ordinance incorporates State Statute requirements to aid in enforcement. <br />Copies of the Ordinance are available at City Hall. <br />Council Member Kuether moved to approve the Second Reading of Ordinance No. 03 - 96, as <br />presented. Council Member Neal seconded the motion. Motion carried unanimously. <br />Ordinance No. 03 - 96 can be found at the end of these minutes. <br />Consideration of MUSA Designation, Pheasant Hills Preserve, 7th Addition - Ms. Wyland <br />stated the preliminary plat for Pheasant Hills Preserve was approved in August of 1990. Nine (9) <br />phases were included in this development and MUSA was allocated to eight (8) of those phases. <br />Mr. Vaughan has switched Phase 9 with Phase 7 and therefore needs additional MUSA <br />designation on that Phase. <br />The Council approved the Final Plat of Pheasant Hills 7th Addition at the June 24, 1996, <br />meeting. That plat consists of 19 lots on 9.44 net acres. Ms. Wyland indicated staff would <br />recommend that 9.44 acres of the recently approved 150 acre MUSA Reserve be allocated to the <br />Pheasant Hills Preserve, 7th Addition. <br />Mayor Landers asked if this item is not approved, will the next item be omitted. Mr. Ahrens <br />stated that if this item is not approved, he will ask Council to accept the bids for the next item, <br />and not award the bid. <br />Council Member Kuether asked if the owner can switch his MUSA from another area to this <br />area. Ms. Wyland indicated the owner can with approval from the Metropolitan Council. <br />Council Member Lyden asked if this issue would still be before Council if the City had not <br />received the extra MUSA acres. Ms. Wyland stated this would not have come before Council if <br />the City had not received the extra MUSA acres. The developer would have to switch MUSA <br />from another area. <br />Council Member Lyden stated that the Council did approve the final plat. The Council assumed <br />there was MUSA already there. Ms. Wyland explained that the Pheasant Hills Preserve <br />development is very unique. It was originally platted in 1990. <br />Council Member Lyden stated he thought there would be perimeters for the 150 acres of MUSA . <br />There has been no discussion regarding how the MUSA should be used. Ms. Wyland stated the <br />City has no other preliminary plats approved at this time. <br />Mayor Landers stated there is no area zoned Light Industrial or Commercial in the area where <br />this MUSA is dedicated. He stated the MUSA cannot be used for commercial users. <br />8 <br />
