AGENDA ITEM 3 B <br />STAFF ORIGINATOR: Mary Kay Wyland <br />DATE: 9/9/98 <br />TOPIC: Resolution No 98-151 Vacating a portion of a Drainage and U <br />Easement on 1270 Chokecherry Road <br />BACKGROVND: <br />The property owner at 1270 Chokecherry Road, Lot 2, Block 4, Brandywood <br />Estates, would like to construct a third stall to his existing two -car garage. The <br />existing garage, however, was constructed up to a large drainage and utility <br />easement. Mr. Barton is therefore asking the City to vacation 14' of this drainage <br />and utility easement to facilitate the proposed construction. <br />We have asked our Consulting Engineer on this project, SEH, to review the <br />request and make recommendation. Mr. Frank Bodine has submitted a letter <br />indicating that vacation of 14' of this easement is possible with the condition that <br />the remainder of the easement is not disturbed. Staff would therefore <br />recommend approval of the attached Resolution No 98-151 vacating the <br />easterly 14' of the drainage and utility easement on Lot 2, Block 4, Brandywood <br />Estates. <br />OPTIONS: <br />1. Adopt Resolution No. 98-151 <br />2. Return to staff for further consideration <br />RECOMMENDATION: <br />Option 1 <br />
