The situation in this case is unique and was created many years ago, most likely
prior to established zoning regulations.
C. That the hardship is not due to economic considerations alone and a reasonable use for the
property exists under the terms of the ordinance. Economics are not an issue in this case..
D. That granting the variance requested will not confer on the applicant any special privilege that
would be denied by this ordinance to other lands, structures, or buildings in the same district.
Staff would consider a similar request given a similar situation.
E. That the proposed actions will not unreasonably diminish or impair established property values
within the neighborhood. Property values should be enhanced with this proposed construction.
F. That the proposed actions will be in keeping with the spirit and intent of the ordinance. The
proposed variances are in keeping with the spirit and intent of the ordinance.
The Planning and Zoning Board reviewed this matter at their September meeting
and recommended approval of the Variance as submitted.
OPTIONS:
1. Approve variance to Section 3, Subdivision 2, B.9 of the City's Zoning
Ordinance.
2. Return to staff for further consideration.
RECOMMENDATION:
Option 1
