AGENDA iTEMMt D <br />STAFF ORIGINATOR: Alan Brixius/Mary Kay Wyland <br />DATE: 11/18/98 <br />TOPIC: PUBLIC HEARING, Zoning Ordinance Text Amendment, Non- <br />conforming Structures (4/5th Vote) <br />BACKGROUND: <br />The Planning and Zoning Board suggested the following Text Amendment as a <br />result of the recent Variance request from a property owner on Bald Eagle Blvd. <br />This amendment would allow additions to non- conforming structures provided <br />there is no increase in the number of units or an expansion in the degree of non- <br />conformity. The Zoning Ordinance, Section 3, Subd. 2 B.9 currently reads as <br />follows: <br />Alterations may be made to a structure containing non - conforming <br />residential units when they will improve the livability thereof, provided they will <br />not increase the number of dwelling units or expand size of existing building or <br />structure. <br />The proposed language is as follows: <br />Alterations may be made to a structure containing non - conforming <br />residential units when they will improve the livability thereof, provided they will <br />not increase the number of units or expand the size or degree of non - conformity. <br />Staff would recommend approval of the First Reading of the attached Ordinance <br />Amendment. <br />OPTIONS: <br />1. Approve Ordinance Amendment. <br />2. Retum to staff for further consideration. <br />RECOMMENDATION: <br />Option 1 <br />
