• <br />0 <br />9 <br />AGENDA ITEM 1B <br />STAFF ORIGINATOR: Julie Bartell, City Clerk <br />MEETING DATE: September 14, 2009 <br />TOPIC: Resolution No. 09 -63, ratifying the City's practice <br />of investigating liquor license renewal applicants <br />VOTE REQUIRED: 3/5 <br />BACKGROUND <br />The council received a report at the August work session regarding the city's process <br />for investigation of liquor license applicants. The city currently requires and charges <br />an established fee on initial applications and also on license renewal applications. The <br />city attorney advised that while state statute clearly requires an initial background <br />check, an investigation on renewal applicants is optional. It was recommended that <br />the city council pass a resolution explaining the rationale for the renewal investigations <br />and to amend the city code to remove "particular application" language. <br />A resolution ratifying the City's practice of investigating liquor license renewal <br />applicants is attached. The appropriate amendment to the liquor licensing section of <br />the city code will be included in the new code that will be considered by the council as <br />part of the current recodification project. <br />RECOMMENDATION <br />Approval of Resolution No. 09 -63, Ratifying the City's practice of investigating liquor <br />license renewal applicants <br />
