• <br />Council Member ga (1 t .� introduced the f Ilowing resolution and moved its adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 09 -9( <br />RESOLUTION DECLARING A VACANCY ON THE CITY COUNCIL <br />WHEREAS, Council Member Dan Stoltz submitted his resignation from the Council in <br />writing on October 26, 2009; and <br />WHEREAS, under Section 2.05 of the Lino Lakes City Charter, a vacancy is deemed to <br />exist upon such resignation and the Council is required to declare the vacancy by <br />resolution; and <br />WHEREAS, Section 4.05, subdivision 5, of the Lino Lakes City Charter provides that <br />when a vacancy occurs within 60 days prior to a regular election, a notice of the <br />vacancy shall be published as soon as is practical and the candidate for Council <br />Member with the third highest vote total in the upcoming election shall fill the vacancy. <br />NOW, THEREFORE, BE IT RESOLVED BY TH E CITY COUNCIL OF THE CITY OF <br />LINO LAKES, MINNESOTA that: <br />1. The Council sat occupied by Council Member Stoltz is hereby declared vacant <br />due to his resignation. <br />2. The City Clerk is directed to publish notice of the vacancy as soon as possible in <br />the official newspaper, a daily newspaper of general circulation in the area, as <br />well as on the City website, in City Hall, and any other location wherein notice of <br />elections are posted. <br />3.
