• O'Donnell Council Member introduced the following resolution and moved its adoption: CITY OF LINO LAKES RESOLUTION NO. 09-117 RESOLUTION DISSOLVING SITE AGREEMENT BETWEEN THE CITY OF LINO LAKES AND CENTENNIAL SCHOOL DISTRICT NO. 12 WHEREAS, In 2003, Site Agreement was executed that combined the Rice Lake Elementary School Site Agreement (1991), the Centennial Middle School Site Agreement (1997), and Blue Heron Elementary School; and WHEREAS, To assist in balancing the 2010 budget, the termination of the Site Agreement between the City of Lino Lakes and Centennial School District No. 12 (CSD) was agreed upon by the City Council as a cost saving measure; and WHEREAS, The Site Agreement states, "This Agreement shall continue and be automatically renewed annually commencing on January 1, unless either party is served written notice at least thirty (30) days prior to January 1 of each year that it intends to terminate or modify this agreement;" and WHEREAS, The City of Lino Lakes sent written notice on September 22, 2009 notifying • the Centennial School District No. 12 of the City's intent to terminate the Site Agreement as required. • NOW, THEREFORE, BE IT RESOLVED, the Lino Lakes City Council hereby officially acknowledges the termination of the Site Agreement between the City of Lino Lakes and Centennial School District No. 12. ell, City Cle erges•� , ayor Adopted by the` Lino Lakes City Council this 28th day of December, 2009. The motion for the adoption of the foregoing resolution was duly seconded by Council Member RoPsPr and upon vote being taken thereon, the following voted in favor thereof: O'Donnell, Roeser, Gallup, Reinert, Bergeson The following voted against same: none Whereupon said resolution was declared duly passed and adopted.
