Tachida, being first duly sworn upon oath, deposes and says as follows: 1. That he is the President of Land and Oaks Inc., a corporation under the laws of the State of Minnesota. 2. On September 1, 1977 Land and Oaks Inc. entered into a Purchase Agreement naming Land and Oaks Inc. as buyer and Cyril H. LaCasse and Catherine M. LaCasee as sellers for the purchase and sale of certain property si.t:vated in the County of. Annke, State of M.i.nneeota lega.l].y deoarihed ad Colloweu The West One -half of the Southeast Quarter of the Northeast Quarter, Section 24, Township 31, Range 22 and that portion of the Northeast Quarter of the Southeast Quarter, Section 24, Township 31, Range 22 lying north of Clear Water Creek except the part belonging to Northern States Power Company containing 35 acres more or less. 3. A copy of the Earnest Money Contract is attached hereto. 4. By mutual agreement the closing of the purchase was indefinitely delayed. 5. Land and Oaks Inc. has paid to the sellers at least $15,000.00 toward the purchase price of the property. 6. Ay mutual rnnnnnt, the AAllers have continued to farm the property end received thn cropn rained thereon. 7. Land and Oaks Inc. now wishes to complete the purchase of the property by paying the balance of the purchase price owing and receiving a warranty deed for the property. Affiant is making this Affidavit for the purpose of placing on record the interest which Land and Oaks Inc. clajms in the subject property.
