• <br />Council MemberXei Aertintroduced the following resolution and moved its adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 09 -34 <br />RESOLUTION APPROVING JOINT POWERS AGREEMENT <br />WITH COUNTY OF ANOKA — RICE CREEK NORTH REGIONAL TRAIL <br />IMPROVEMENTS <br />WHEREAS, the County and the City desire to extend and construct certain <br />improvements to the Rice Creek North Regional Trail; and <br />WHEREAS, the improvements include the extension of the Rice Creek North <br />Regional Trail from the YMCA Community Center in Lino Lakes south through the Rice <br />Creek Chain of Lakes Park Reserve and the Chomonix Golf Course to Rice Lake <br />Elementary School; and <br />WHEREAS, the improvements also include upgrades to existing trails, including <br />the trail through the Rice Creek Elementary School property; the existing County trail <br />along Birch Street to Ware Road; the existing City of Lino Lakes trail on the east side of <br />Ware Road from Birch Street south to Ash Street; and the existing City of Shoreview <br />trail that goes west along County Road J from Ware Road to Lexington Avenue; and <br />WHEREAS, Anoka County will be responsible for all costs associated with these <br />upgrades; and <br />WHEREAS, Minn. Stat. § 471.59 authorizes political subdivisions of the State of <br />Minnesota to enter into joint powers agreements for the joint exercise of powers <br />common to each. <br />NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />LINO LAKES, MINNESOTA: <br />That the City Council hereby approves the Joint Powers Agreement with the County of <br />Anoka for the Construction of Improvements to and Extension of the Rice Creek North <br />Regional Trail and authorizes the Mayor and City Clerk to execute said agreement on <br />behalf of the City. <br />n <br />e Bartell, Ci y Cler <br />John J erg on, ayor <br />Adopted by the Lino Lakes City Council this 8th day of June, 2009. <br />
