Council Membei0' Donnelmtroduced the following resolution and moved its adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 09 -39 <br />RESOLUTION APPROVING AN EXTENSION OF TIME FOR THE SUBMITAL OF <br />THE FINAL PLAT CENTURY FARM NORTH 5TH ADDITION <br />WHEREAS, review and approvals of plats are governed by state statutes and City ordinances, and <br />WHEREAS, the Planned Unit Development — Development Stage Plan for Century Farm North, approved by the <br />City Council on April 28, 2003 with Resolution 03 -60, included a phasing plan for final platting a specified number <br />of units each year, and <br />WHERAS, the phasing plan also specified numbers of acres of Metropolitan Urban Service Area (MUSA) reserve <br />that would be granted to each annual phase, and <br />WHERAS, the city's Subdivision and Platting Ordinance requires the final plat for subsequent phases be submitted <br />within one year of approval of the final plat for the previous phase, and <br />WHEREAS, a request has been submitted to the City to extend the time allowed for submittal of a final plat upon <br />approval by the City Council, and <br />WHEREAS, the Planned Unit Development — Development Stage Plan for Century Farm North is still in <br />compliance with City requirements. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lino Lakes hereby approves an <br />extension to the submittal time of the final plat for Century Farm North 5th Addition, subject to the following <br />conditions: <br />1. The complete Final Plat for Century Farm North 5th Addition must be submitted by <br />April 30, 2010; unless an additional extension is granted by the City Council. <br />2. All conditions of approval for Resolution No. 03 -60 will continue to apply to the site. <br />3. The 9.4 Acres of MUSA reserve assigned to Century Farm North 5th Addition by <br />Resolution No. 03 -60 shall not be reallocated to a different project if the final plat for <br />the 5th Addition is submitte. , • • p it 30, 2010. <br />i.ei:- <br />Joh/ Ber ion, '1, yor <br />ATTEST: <br />-4 <br />artell, CityJClertt <br />Adopted by the Lino Lakes City Council this 22nd day of June, 2009. <br />The motion for the adoption of the foregoing resolution was duly seconded by Council Member Gallup <br />and upon vote being taken thereon, the following voted in favor thereof: <br />O'Donnell, Gallup, Reinert, Bergeson <br />The following voted against same: <br />none (Absent - Stoltz) <br />Whereupon said resolution was declared duly passed and adopted. <br />
