• <br />XIII. CONDITIONS OF APPROVAL <br />1. The Conditions associated with both Automobile /Truck Repair and Accessory <br />Retail Sales shall be attached to the approval of the Conditional Use Permits and <br />must be complied with at all times. <br />2. The comments made by the City Engineer shall be addressed prior to the City <br />Council consideration of this request. <br />3. The paving and curb required on the rear of the lot shall be completed by June 1, <br />2010, and appropriate financial securities shall be submitted to the city to <br />guarantee that the work is completed. <br />4. Hours of Operation for this use shall be limited to lam — 7pm Monday through <br />Saturday and 9am — 5pm on Sunday. <br />5. All repair or installation work shall be completed inside the building with all <br />doors closed to limit impacts on the surrounding area. <br />XIV. VIOLATIONSBUILDING PERMITS <br />In the event that Developer violates any of the covenants and agreements <br />contained in this Site Improvement Performance Agreement and to be performed <br />by the Developer, the City, at its option, in addition to the rights and remedies as <br />set out hereunder may refuse to issue building permits to any property within the <br />development and/or stop building construction within the development until such <br />time as such default has been corrected to the satisfaction of the City. <br />January 11, 2010 The Boarhouse at 7317 / 7319 Lake Drive - Performance Agreement Page 7 of 8 <br />
