• <br />• <br />• <br />ATTACHMENT A, Resolution No. 10 -13 <br />CITY OF LINO LAKES <br />COUNTY OF ANOKA <br />SUMMARY OF ORDINANCE NO. 04-10 <br />AN ORDINANCE AMENDING THE ZONING ORDINANCE TO AMEND <br />REQUIREMENTS FOR OUTDOOR SEATING AND DEFINE GOLF COURSE USES <br />Section 1: Findings: 1) The Lino Lakes Zoning Ordinance currently requires a conditional use <br />permit for restaurants with accessory outdoor dining facilities. 2) Some current language in the <br />ordinance is ambiguous. 3) A conditional use permit adds time and expense for a business <br />without providing a benefit to the public that can't be otherwise provided. 4) Outdoor seating is <br />a suitable use in business districts. 5) The amendments support policies and strategies in the <br />Comprehensive Plan. 6) The Lino Lakes Planning & Zoning Board held a public hearing on the <br />amendments on February 10, 2010 and recommended approval. <br />Section 2: The Zoning Ordinance is amended as follows: <br />Section 1 Definitions: New Golf Course definition that includes accessory uses typically <br />associated with golf courses. New Miniature Golf Course definition that does not include <br />those accessory uses. Amend definition of Recreation Area to delete golf courses. <br />Section 3 General Provisions: Add performance standards for Accessory Outdoor Dining or <br />Seating Facilities. <br />Section 7: Neighborhood Business, Limited Business, and General Business zoning districts: <br />add Accessory Outdoor Dining or Seating Facilities as uses by administrative permit and <br />delete as conditional use. <br />Section 3 As above amended, said Zoning Ordinance shall stand as initially passed and <br />previously amended. <br />Section 4: This ordinance shall be in effect in accordance with the City Charter. <br />Passed by the Lino Lakes City Council on March 8, 2010.
