• <br />• <br />O'Donnell <br />Council Member introduced the following resolution and moved its adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 10 -22 <br />RESOLUTION APPROVING CHANGE ORDER NO. 19 <br />LAKE DRIVE /135W IMPROVEMENT PROJECT <br />WHEREAS, pursuant to the resolution of the City Council adopted May 14, 2007, the <br />City awarded the construction contract for the Lake Drive /I -35W Improvement Project to <br />Lunda Construction Company; and <br />WHEREAS, the construction contract specifications provide for the assessment of <br />Liquidated Damages for delay in project completion for both substantial completion and <br />final completion; and <br />WHEREAS, the project engineer has determined that substantial completion was <br />delayed 26 days ($3,000 per day) and final completion was delayed 91 days ($500 per <br />day) and should be assessed in accordance with the contract specifications. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />LINO LAKES, MINNESOTA: <br />1. Change Order No.19, is hereby approv- . n the ded <br />Bartell, City 1 Jerk <br />un o $123,500.00 <br />einert Mayor <br />Adopted by the Lino Lakes City Council this 8th day of March, 2010. <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member Roeser and upon vote being taken thereon, the following voted in favor <br />thereof: <br />O'Donnell, Roeser, Gallup, Rafferty, Reinert <br />The following voted against same: <br />none <br />Whereupon said resolution was declared duly passed and adopted. <br />
