MEETING DATE: April 26, 2010 <br />TOPIC: Consideration of Resolution No. 10 -34 <br />Extension of Time for The Preserve <br />VOTE REQUIRED: Simple Majority <br />BACKGROUND <br />In 2006 the City Council approved The Preserve, a residential subdivision. This approval <br />included: <br />- Ordinance 08 -06: Rezone to Planned Unit Development (PUD) <br />- Resolution 06 -137: Development Stage Plan/Preliminary Plat <br />A PUD development stage plan must be followed by the final plan application within twelve <br />months. Likewise, a final plat must be submitted within one year of the preliminary plat <br />approval. The project did not meet these deadlines due to the widespread slowdown in <br />development in the region. The City extended the deadline twice with Resolutions 08 -109 and <br />09 -77. The recommendation is to extend the PUD final plan/final plat submittal deadline once <br />again. <br />The preservation of open space on this site will be an important step in the implementation of the <br />City's larger greenway vision. The Preserve site includes a high value natural resource area that <br />includes a major drainage through the southern part of Lino Lakes. Permanent open space is to <br />be created behind most lots that extends for hundreds of feet. These areas are to be placed in a <br />permanent conservation easement. The approval included a restoration and management plan for <br />wetlands and other open space. A public trail also would be created. <br />OPTIONS <br />1. Approve Resolution No. 10 -34 granting an extension for submitting the PUD -final plan /final <br />plat. <br />2. Deny Resolution No. 10 -34. <br />3. Return to staff with direction. <br />RECOMMENDATION <br />Option 1 <br />
