Council MemberO' Donnell introduced the following resolution and <br />moved its adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 10 -88 <br />RESOLUTION DECLARING COSTS TO BE RE- ASSESSED, PINE STREET <br />PAVING IMPROVEMENTS <br />WHEREAS, a resolution of the City Council adopted the 28th day of September 2009 <br />called for a Public Hearing on the proposed paving improvements of Pine Street from <br />Lake Drive to 4th Avenue, <br />AND WHEREAS, ten days' mailed notice and two weeks' published notice of the <br />hearing was given, and the hearing was held thereon on the 26th day of October, 2009, at <br />which all persons desiring to be heard were given an opportunity to be heard thereon, <br />AND WHEREAS, Resolution 10 -39, Declaring Costs to be Assessed, Pine Street Paving <br />Improvements approved on April 26, 2010 is being replaced with this resolution based on <br />the final project costs, <br />AND WHEREAS, The costs to pave Pine Street will be split as a 50% - 50% cost share <br />with the City of Columbus and it is proposed to finance the project with special <br />assessments assessed 100% to the benefited property owners, <br />AND WHEREAS, this improvement project is subject to a Joint Powers Agreement <br />between the City of Columbus and the City of Lino Lakes Regarding the Pine Street <br />Paving Improvements and Maintenance, <br />WHEREAS, pursuant to a resolution passed by the council on January 25, 2010, TKDA <br />has prepared plans and specifications for the paving improvement of Pine Street and has <br />presented such plans and specifications to the council for approval, <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />LINO LAKES, MINNESOTA: <br />1. The project is 100% assessed to the benefited property owners. The City will be <br />re- assessing $169,647.44 at this time. <br />2. Assessments shall be payable in equal annual installments extending over a period <br />of 15 years, and shall bear interest at the rate of 7 percent per annum from the date <br />of the adoption of the assessment resolution. <br />3. The City Clerk, with the assistance of the City Engineer, shall forthwith calculate <br />the proper amount to be specially re- assessed for such improvement against every <br />assessable lot, piece or parcel of land within the district affected, without regard to <br />
