Council Member . %j 't7i introduced the following resolution and moved its adoption: <br />CITY OF LINO LAKES <br />COUNTY OF ANOKA <br />RESOLUTION NO. 08 -11 <br />FINDING A VIOLATION OF LIQUOR CODE AND IMPOSING PENALTY <br />MILLER'S ON MAIN <br />WHEREAS, The Lino Lakes Code of Ordinances, Section 701.09, Subdivision 4, Vacation of <br />Premises, requires that anyone other than the licensee or employees must vacate the <br />premises of a licensed liquor establishment within thirty minutes after the time during which <br />sales can be made; and <br />WHEREAS, Miller's on Main has been issued a 2:00 a.m. permit allowing them sale of liquor <br />up to 2:00 a.m.; and <br />WHEREAS, on June 21, 2007, the Lino Lakes Police Department of Lino Lakes found <br />several patrons inside the Miller's on Main establishment after legal hours of operation; and <br />WHEREAS, the City Council of Lino Lakes conducted a violation hearing on February 11, <br />2008 and reached a finding that a violation did occur; and <br />WHEREAS, the City Council has agreed to impose penalties consistent with the Best <br />Practices Grid; and <br />WHEREAS, the recommendation under the Best Practices Grid is a $500 civil penalty; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO <br />LAKES, MINNESOTA: <br />The City of Lino Lakes hereby adopts Resolution No. 08 -11, Finding a Violation of the Liquor <br />Code and Imposing Penalty to Miller's on Main. <br />Adopted by the Council of the City of Lino Lakes this 11th day of February, 2008. <br />John Bergeson, Mayor <br />Julianne Bartell, City Clerk <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member and upon vote being taken thereon, the following voted in favor thereof: <br />The following voted against same: <br />Whereupon said resolution was declared duly passed and adopted. <br />
