Council Membel1Donnell introduced the following resolution and moved its adoption: <br />CITY OF LINO LAKES <br />COUNTY OF ANOKA <br />RESOLUTION NO. 08 -21 <br />AGREEMENT EXTENDING GRANTEE'S OBLIGATION TO COMPLY WITH <br />LIVABLE COMMUNITIES DEMONSTRATION ACCOUNT <br />GRANT AGREEMENT CONDITION <br />Whereas, on December 20, 2000 the City Council (City) received a $450,000 Livable <br />Communities Demonstration Account grant to help support mixed - income housing in Legacy <br />at Woods Edge from the Metropolitan Council (Council); and <br />Whereas, the grant agreement included a condition to install a traffic signal on the <br />northbound off -ramp of I -35W to serve the development and existing development in Lino <br />Lakes; and <br />Whereas, on March 12, 2003 the City and the Council entered into grant agreement No. SG- <br />00 -135 which made the City's receipt of funds subject to the condition; and <br />• Whereas, on August 24, 2005 the City requested payment of the $450,000; and <br />• <br />Whereas, on September 30, 2005 the City and the Council executed an amendment to the <br />grant agreement under which the City agreed to reimburse the $450,000 by January 31, 2008 <br />if the signal was not installed by December 31, 2007; and <br />Whereas, full reconstruction of the I -35W Lake Drive bridge and interchange is now expected <br />to be complete by June of 2008 and City staff requested an extension of the deadline for <br />signal installation; and <br />Whereas, at its January 9, 2008 meeting the Council gave the City until August 31, 2008 to <br />fulfill the traffic signal condition. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO <br />LAKES, MINNESOTA: <br />The City agrees to the representations made and agrees as follows: <br />1. The Council will forebear on its right to seek reimbursement of the $450,000 grant <br />amount until August 31, 2008. <br />2. The City will inform the Council in writing when the traffic signal is operational. <br />3. If the signal is not operational by August 31, 2008, the City will reimburse the Council <br />the entire $450,000 grant amount by September 15, 2008. <br />4. If the City does not reimburse the Council by September 15, 2008, the Council has a <br />right to seek immediate reimbursement of the grant amount. <br />
