• <br />• <br />Council Member Stoltz introduced the following resolution and moved its adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 08 -25 <br />RESOLUTION APPROVING CHANGE ORDER NO. 10 <br />LAKE DRIVE /I35W IMPROVEMENT PROJECT <br />WHEREAS, pursuant to the resolution of the City Council adopted May 14, 2007, the City <br />awarded the construction contract for the Lake Drive /I -35W Improvement Project to Lunda <br />Construction Company, and <br />WHEREAS, the aggregate test reports and material disposition forms compiled by Mn /DOT <br />indicate that on August 20, 2007 the coarse aggregate for ready -mix concrete failed to meet the <br />gradation requirements for Mn /DOT Specification 3137 CA -50, and <br />WHEREAS, upon recommendation of the Mn /DOT Concrete Office, the concrete containing the <br />deficient material will be allowed to remain in place at a reduced price. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO <br />LAKES, MINNESOTA: <br />1. Change Order No.10, deducting the amount of $360.00, is hereby approved. <br />Julian e Bartell, City Jerk <br />Adopted by the Lino Lakes City Council this 25th day of February, 2008. <br />J. B- •eson, Mayor <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member O'Donnell and upon vote being taken thereon, the following voted in favor <br />thereof: Stoltz, O'Donnell, Gallup, Reinert, Bergeson <br />The following voted against same: <br />none <br />Whereupon said resolution was declared duly passed and adopted. <br />
