• • Council Member Stoltz introduced the following resolution and moved its adoption: CITY OF LINO LAKES RESOLUTION NO. 08 -25 RESOLUTION APPROVING CHANGE ORDER NO. 10 LAKE DRIVE /I35W IMPROVEMENT PROJECT WHEREAS, pursuant to the resolution of the City Council adopted May 14, 2007, the City awarded the construction contract for the Lake Drive /I -35W Improvement Project to Lunda Construction Company, and WHEREAS, the aggregate test reports and material disposition forms compiled by Mn /DOT indicate that on August 20, 2007 the coarse aggregate for ready -mix concrete failed to meet the gradation requirements for Mn /DOT Specification 3137 CA -50, and WHEREAS, upon recommendation of the Mn /DOT Concrete Office, the concrete containing the deficient material will be allowed to remain in place at a reduced price. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO LAKES, MINNESOTA: 1. Change Order No.10, deducting the amount of $360.00, is hereby approved. B- •eson, Mayor The motion for the adoption of the foregoing resolution was duly seconded by Council Member O'Donnell and upon vote being taken thereon, the following voted in favor thereof: Stoltz, O'Donnell, Gallup, Reinert, Bergeson The following voted against same: none Whereupon said resolution was declared duly passed and adopted.
