• <br />Council Member Stoltz introduced the following resolution and moved its adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 08 -37 <br />RESOLUTION APPROVING CHANGE ORDER NO. 12 <br />LAKE DRIVE /I35W IMPROVEMENT PROJECT <br />WHEREAS, pursuant to the resolution of the City Council adopted May 14, 2007, the City <br />awarded the construction contract for the Lake Drive /I -35W Improvement Project to Lunda <br />Construction Company, and <br />WHEREAS, the aggregate test reports and material disposition forms compiled by Mn /DOT <br />indicate that on August 20, 2007 the coarse aggregate for ready -mix concrete failed to meet the <br />gradation requirements for Mn /DOT Specification 3137 CA -50, and <br />WHEREAS, on February 25, 2008 the City Council approved Change Order No. 10 deducting <br />$360.00 from the contract price in accordance with the contract provisions, and <br />WHEREAS, upon further review, Mn /DOT's concrete office has determined that the specified <br />ready -mix concrete should be accepted as in substantial compliance. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO <br />LAKES, MINNESOTA: <br />1.
