DEVELOPMENT CONTRACT <br />Vaughan's First Addition <br />THIS AGREEMENT made this 28th day of April 2008, is by and between the City <br />of Lino Lakes, whose address is 600 Town Center Parkway, Lino Lakes, Minnesota, 55014, a <br />municipal corporation organized under the laws of the State of Minnesota, hereinafter referred to as <br />the "City ", and Ed Vaughan whose address is 1432 Pheasant Hills Drive, Lino Lakes, Minnesota <br />55038 hereinafter referred to as the "Developer ". <br />WHEREAS, the Developer has received preliminary plat approval from the City <br />Council for a plat of land within the corporate limits of the City known as Vaughan's First <br />Addition, hereinafter called "Subdivision ", said land is legally described to -wit <br />Outlot D, Pheasant Hills Preserve, Anoka County, Minnesota, <br />EXCEPT that part of Outlot D, Pheasant Hills Preserve, being in the West One- <br />half of the Northwest One - Quarter, Section 27, Township31, Range 22, Anoka <br />County, Minnesota, described as follows: <br />Commencing at the Southeast corner of the West One -half of said Northwest One- <br />quarter, Section 27; thence North 01 degrees 00 minutes 55 seconds West along <br />the East line of said West One -half, Northwest One - quarter, Section 27, a distance <br />of 57.73 feet to the Southeast corner of said Outlot D for a point of beginning of <br />the tract to be described; thence North 01 degree 00 minutes 55 seconds West, <br />along the East line of said Outlot D, a distance of 910.02 feet; thence South 89 <br />degrees 22 minutes 49 seconds West, a distance of 580.47 feet; thence South 01 <br />degree 00 minutes 55 seconds East, parallel with the East line of said Outlot D, a <br />distance of 548.90 feet; thence North 89 degrees 22 minutes 49 seconds East, <br />parallel with the South line of said Northwest One - quarter, Section 27, a distance <br />of 416.00 feet; thence South 01 degree 00 minutes 55 seconds East, parallel with <br />the East line of said Outlot D a distance of 370.14 feet to the Northerly right -of- <br />way line of C.S.A.H. No. 10 (Anoka County Right -of -Way Plat No. 11); thence <br />North 85 degrees 24 minutes 36 seconds East along said right -of -way line a <br />distance of 28.66 feet; thence continuing along said right -of -way line along a <br />
