MEETING DATE: September 22, 2008 <br />TOPIC: Consideration of Resolution No. 08 -103: <br />Golden Acre Final Plat Extension of Time <br />VOTE REQUIRED: Simple Majority <br />BACKGROUND <br />On August 27, 2007 the City Council adopted Resolution No. 07 -103, approving the Final Plat <br />for Golden Acre, a four lot residential subdivision on the north side of Lois Lane, approximately <br />175 feet east of Meadowview Trail. <br />Final Plats are required to be recorded within 90 days, and on November 26, 2007 the City <br />Council adopted Resolution No. 07 -188, which approved an extension of time for the Final Plat. <br />The deadline for recording was set at February 23, 2008. <br />The applicant did not meet this deadline and again has requested additional time to record the <br />final plat. For the purpose of record keeping and ongoing monitoring of all approvals extended <br />at this time, staff is recommending the deadline be extended to April 31, 2009. <br />The escrow account for Golden Acre has a balance of $693.17 which the city will continue to <br />hold for conversion to the development agreement. The development agreement is still valid <br />until the new deadline of April 31, 2009. However, the title commitment documents that were <br />submitted with the final plat approval are now far past valid and new commitment documents <br />will need to be submitted along with the development agreement and financial securities prior to <br />receiving a signature on the final plat mylar. <br />RECOMMENDATION <br />Staff is recommending adoption of Resolution No. 08 -103 approving an extension of the Final <br />Plat approval, subject to the following conditions: <br />1. The Final Plat for Golden Acre must be recorded by April 31, 2009; unless an <br />additional extension is granted by the City Council. <br />2. All conditions of approval for Resolution No. 07 -103 will continue to apply to the site. <br />3. Updated title commitment documents must be submitted and reviewed prior to the <br />city signing the final plat mylar. <br />ATTACHMENTS <br />1. Resolution No. 08 -103 <br />2.
